Tender for Photovoltaic Power Station Installation Project in Ustroń, Poland

Project Title: Execution of photovoltaic installation in the building of Primary School No. 5 in the city of Ustroń, as part of the investment task titled "Construction of renewable energy sources in the city of Ustroń".

Project Description: The order scope includes the execution of photovoltaic installation in the building of Primary School No. 5 in the city of Ustroń. All works must be carried out in accordance with the technical documentation and, due to the building's nature, require continuous coordination with the facility administrator or their designated person and the investment supervision engineer. The Contractor is obliged to report the photovoltaic system connection to Tauron Dystrybucja and notify the State Fire Service about the completion of the photovoltaic installation and its planned commissioning. Works will be carried out in an operational building.

Procurement Procedure: Open tender (unlimited tender) conducted in accordance with the Public Procurement Law of 11 September 2019. The procedure will be conducted in the so-called "reverse" procedure (i.e., applying Article 139(1) of the Act).

Exclusion Grounds: According to Article 108 of the Polish Public Procurement Law, there are multiple grounds for exclusion, including participation in a criminal organization, corruption, fraud, terrorist offences, money laundering, financing of terrorism, use of child labour and human trafficking, serious breaches of tax or social security contribution obligations, agreements aimed at distorting competition, direct or indirect participation in the preparation of this tender, breach of purely domestic exclusion obligations (including based on Article 7 of the Act of 13 April 2022 on special measures to counteract support for aggression against Ukraine and to protect national security, and measures under Article 5k of Council Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine, etc.). Tenderers must submit a declaration pursuant to Article 125(1) (using the uniform European procurement document form) together with the tender.

Qualification Requirements - Experience: The tenderer must prove that within the last 5 years (or during its shorter period of operation) it has properly executed at least 2 photovoltaic installation projects, each with a minimum value of PLN 100,000 (including VAT). This can be under separate contracts. For joint tenders, resources can be aggregated to meet this requirement.

Qualification Requirements - Personnel Qualifications: The tenderer must prove that it has or will have at least 1 qualified person able to participate in the order execution, holding one of the following valid qualifications: 1) Certificate of installer of renewable energy sources issued by the Office of Technical Inspection; or 2) Valid qualification certificate authorizing the operation of devices and networks within the scope of supervision and measurements; or 3) Construction qualification in the specialty of electrical and power equipment and installations (or equivalent valid qualification issued under previous regulations), registered with the appropriate professional self-government body in accordance with relevant laws; or 4) Fulfillment of the conditions specified in Article 12a of the Construction Law or Article 20a of the Act on the Professional Self-Government of Architects, Civil Engineers and Urban Planners (regarding cross-border services).

Contract Form: Joint tenders by tenderers are permitted. Joint tenderers must appoint a common representative and submit a corresponding power of attorney (except for civil law partnerships if such power is included in the attached partnership agreement or if all partners sign the tender). A declaration pursuant to Article 117(4) of the Public Procurement Law must be submitted, clearly specifying the specific works, supplies, or services to be performed by each tenderer.
