Qualification and Selection Criteria:

Registration and Authorization: The tenderer and its consortium members/subcontractors/supporting third parties must be registered with the National Trade Register Office or corresponding national authority, and their activity scope (CAEN code) must correspond to the subject of the contract. The winning tenderer must submit a certificate of proof.

Similar Project Experience: Successful completion of a maximum of 2 contracts for similar road infrastructure new construction/rehabilitation/modernization works within the past 5 years, with a cumulative value not less than 33,000,000 Lei (excluding VAT). Proof documents such as acceptance minutes, completion minutes, or certificates of good execution issued/countersigned by the beneficiary must be provided.

Personal Situation: The tenderer, consortium members, subcontractors, and supporting third parties must not be in situations defined in Articles 164, 165, 167 of Law No. 98/2016 (bankruptcy, liquidation, conflict of interest, exclusion from participation, etc.). The winning tenderer must submit documents such as tax certificates and judicial records.

Conflict of Interest Declaration: A declaration must be submitted confirming no conflict of interest with the contracting authority's decision-making personnel listed in the documents (Mayor, Deputy Mayor, local councilors, procurement advisors, etc.).

Award Criteria (Total 100 points):

Price (60 points): Lowest price receives 60 points, others calculated proportionally.

Works Warranty Period (5 points): Minimum requirement 36 months (0 points), 72 months or more receives full 5 points, linear interpolation between 36-72 months. Less than 36 months is considered non-compliant.

Adequacy of Project Implementation Plan (10 points): Evaluates the correlation of the schedule with resources and methods, clarity and optimization of milestone and critical path definition. Graded as Satisfactory (3 points), Adequate (6 points), Very Good (10 points).

Quality Management Plan (15 points): Evaluates quality control methodology, responsibility allocation, correlation with the schedule, and resource optimization. Graded as Satisfactory (5 points), Adequate (10 points), Very Good (15 points).

Construction Site Waste Management (10 points):

Mandatory Minimum Requirement: The recycling/reuse/recovery rate for non-hazardous waste must not be less than 70% (by weight). Failure to meet this is considered non-compliant. Scoring: Minimum 70% receives 0 points, the highest proposed percentage receives 10 points, others calculated proportionally. A detailed waste management plan and self-declaration must be submitted.

Other Key Information:

Clarification Requests: Must be submitted via the Electronic Public Procurement System no later than 20 days before the tender deadline (i.e., by February 17, 2026). The contracting authority will provide a unified response by the 14th day before the tender deadline (i.e., February 23, 2026).

Cost Calculation Freedom: Tenderers have the right and obligation to calculate all costs (especially for Chapter 5.1 "Site Organization") based on their own construction organization, technology, material suppliers, and transport distances, and are not limited by the budget sections.

Technical Specification Equivalence: Any reference to specific manufacturers, brands, patents, origins, etc., is considered as accompanied by the phrase "or equivalent"; equivalent products/solutions are accepted.
