India Plans to Draft New Artificial Intelligence Law

en.Wedoany.com Reported - The central government of India plans to begin constructing a dedicated legal framework for artificial intelligence to address regulatory challenges posed by the rapid evolution of technology. S. Krishnan, Secretary of the Ministry of Electronics and Information Technology, stated at a cybersecurity event organized by the Confederation of Indian Industry (CII) that existing IT rules require a significant shift to tackle issues such as online fraud, deepfakes, and AI-generated synthetic content. The Ministry is currently exploring a specialized regulatory framework for AI.

Policymakers worldwide are grappling with challenges posed by generative AI, including deepfakes, disinformation, and online fraud. India has been tightening IT rules to crack down on activities such as AI-generated deepfakes. When asked about the timeline for new AI regulations, Krishnan stated that the government could prepare a draft legislative proposal, but could not comment on the final timeline for enactment, particularly regarding the legislative process.

Krishnan noted that this is an ongoing dialogue. He and Minister Vaishnaw have previously publicly stated that AI regulation would be considered when the time is right, and that time now appears to be approaching. India has utilized IT rules and other provisions of existing laws to address concerns arising from AI, but the moment may have come to consider standalone legislation. Vaishnaw has indicated that discussions with the industry are underway, and the government will strive to strike a balance between innovation and regulation.

In February this year, the Indian government introduced stricter requirements for online platforms handling AI-generated and synthetic content, mandating that platforms such as X and Instagram must remove such content within three hours of being flagged by a competent authority or court. Last month, Vaishnaw stated that the existing Information Technology Act was formulated before the rapid rise of AI, and a new legal framework may be needed to address the changing landscape.

Regarding the data breach at Tata Electronics, Krishnan said the government is investigating the incident, which allegedly involved sensitive information about unreleased iPhone models from Apple. The incident has been reported to the Indian Computer Emergency Response Team (CERT-In). Reports indicate that a ransomware group, allegedly responsible for stealing data from Tata Electronics, has published component and supplier details, as well as photos of the Apple iPhone 18 Pro model, on the dark web.
