Brazil's Eneva Confirms Fixed Capacity Contracts for Natural Gas Transportation for Three Thermal Power Projects

en.Wedoany.com Reported - Eneva has confirmed to Brazil's National Agency of Petroleum, Natural Gas and Biofuels (ANP) that it has signed fixed capacity contracts for natural gas transportation for the three thermal power plants it won in the March 2026 Capacity Reserve Auction (LRCap), thereby meeting a requirement of the auction notice.

Eneva's Parnaíba Complex houses two plants whose existing contracts expire in 2027, allowing them to participate in the auction now.

The projects involved are UTE Povoação 1 (74.9 MW), UTE Viana 1 (37.4 MW), and UTE Luiz Oscar Rodrigues de Melo (240 MW), all located in the state of Espírito Santo. The documents submitted by Eneva are related to Transportadora Associada de Gás (TAG), the company responsible for the infrastructure transporting natural gas to these projects. ANP stated that these commitments will remain in effect for the duration of the contracts.

All three projects were contracted in the 2026 product, with contract supply starting on August 1, 2026. With Eneva's confirmation of the commitments, all ten power plants contracted in this product have met the requirement to prove to ANP that they have signed fixed capacity contracts for natural gas transportation. In early July, the other seven thermal power plants had already received approval from the agency.

Another incident involves Eneva's natural gas exploration project at the Azulão Complex (Complexo Azulão) in the municipalities of Silves and Itapiranga, Amazonas state. Last week, the Federal Regional Court of the 1st Region (TRF1) unanimously upheld the ruling preventing the project from obtaining new environmental licenses until measures are taken to protect potentially affected indigenous peoples. In dismissing the company's appeal, the 12th Panel confirmed the ruling issued by the federal court in a public civil action filed by the Federal Public Ministry (MPF). However, the TRF1 decision has not yet taken immediate effect, as the first-instance ruling was suspended by a security injunction. The MPF's appeal against this injunction has not yet been heard.

The ruling requires the Amazonas State Environmental Protection Agency (Ipaam) not to issue new licenses for the project until the following are completed: prior, free, and informed consultation (CPLI) with indigenous communities potentially affected by the project, preparation of an Indigenous Component Study (ECI), and completion of the National Foundation for Indigenous Peoples (Funai) study on the Caribi indigenous people, who are registered on the foundation's official list as a case under study. The company's activities in the area, which overlap with the claimed territory of the Gavião Real Indigenous Land, also remain suspended.

TRF1 reiterated that the lack of final certification for the Gavião Real Indigenous Land does not exclude the constitutional protection of that territory. The panel also emphasized that indigenous territorial rights are of an original nature, and according to established understandings of the Federal Supreme Court and the Superior Court of Justice, areas undergoing recognition by Funai are equally entitled to preventive protection.

In a statement, Eneva reiterated its understanding that the complex was licensed in accordance with current legislation, based on permits regularly issued by the competent authorities, and emphasized that the technical opinion from Funai in the case file indicates that there are no demarcated or ongoing demarcations of indigenous lands in the project area. According to the agency's cartographic analysis, the nearest indigenous land is approximately 27.85 km from the Azulão Complex. The company also stressed that the proceedings are still under review, but the TRF1 President's ruling suspending the effects of the first-instance decision remains in effect due to potential impacts on administrative order and national energy security. In its statement, Eneva further stated that its projects are conducted with strict technical standards and in compliance with current laws, respecting regulatory processes and the decisions of competent authorities, while maintaining its commitment to responsible operations, dialogue with local communities, and best social and environmental practices.
