en.Wedoany.com Reported - Peru's Ministry of Energy and Mines (MINEM), through Ministerial Resolution No. 257-2026-MINEM/DM issued on July 2, 2026, has officially approved new content for mine closure plans. This measure aims to improve the quality of environmental documents submitted by mining owners, standardize evaluation criteria, and strengthen oversight of environmental commitments after the cessation of mining operations.

This resolution further refines the relevant provisions of Law No. 28090, the Mine Closure Law, and Supreme Decree No. 006-2025-EM, the revised Mine Closure Regulations. Under the new regulations, the mining sector has established standardized technical content that mining companies must reference when developing their closure plans.
The newly approved mine closure plan content will take effect 90 business days after its publication in the Official Gazette of Peru. This transition period is designed to allow mining companies, environmental consulting firms, and competent authorities to adjust their relevant procedures in accordance with the new regulatory framework.
The regulation includes a transitional supplementary provision to ensure legal certainty during implementation. According to this provision, administrative procedures related to mine closure plans already underway at the General Directorate of Mining Environmental Affairs (Dirección General de Asuntos Ambientales Mineros) will continue to be processed under the regulations in effect at the time they were initiated. Additionally, plans, modifications, or updates still in the preparation phase may continue to apply the previous regulations, provided that mining owners demonstrate their status by submitting contracts signed with consulting firms within 10 business days from the date of the resolution's publication.
