Ho Chi Minh City Department of Construction Issues New Guidelines for Issuance of Private Housing Construction Permits

en.Wedoany.com Reported - The Vietnam Ho Chi Minh City Department of Construction recently issued a guiding document, providing specific instructions to People's Committees of communes, wards, and special zones regarding the issuance of private housing construction permits and construction order management following the implementation of the 2025 Law on Construction.

Commune-level People's Committees have the authority to issue construction permits for Grade III and Grade IV construction works, as well as private houses of households and individuals, within their jurisdiction.

The issuance of construction permits must ensure compliance with land use purposes and meet the requirements of one of the corresponding types of planning. Works must ensure safety, environmental protection, fire prevention, and the connection capacity of technical infrastructure. The construction design must have been established, appraised, and approved in accordance with the law.

Applications for construction permits must meet the requirements for each type of work as prescribed. The dossier for a new permit includes: a construction permit application form filled out according to a fixed template, legal documents proving land use rights, and a set of architectural design drawings. If the construction work has not commenced by the expiry of the construction permit's validity period, the investor must apply for an extension. Each construction permit may be extended a maximum of two times, with each extension lasting 12 months.

People's Committees of communes, wards, and the special zone of Con Dao bear full responsibility for managing construction order for Grade III and Grade IV works and private houses within their jurisdiction. Management shall cover the entire process of the work, from receiving the construction commencement notice and the start of construction, to the completion inspection and handover for use.

For works within the scope exempt from construction permits, commune-level People's Committees must inspect whether they meet the exemption conditions, and check whether the construction complies with the established planning serving as the basis for project approval, as well as the main contents and parameters of the architectural design in the feasibility study report appraised by specialized agencies.

The Ho Chi Minh City Department of Construction advises that when violations are detected locally, authorities must order a halt to construction, monitor the suspension process, and take necessary measures to enforce the stoppage. At the same time, enforcement measures against works violating construction order shall be implemented within their authority.
