Performance Bond: Required (specific amount not specified) Technical or Professional Capacity (Part 1): At least 1 completed construction works contract within the past 5 years (or within the shorter period of operation) involving road construction, reconstruction, or renovation using the same technology (minimum asphalt concrete pavement area of 300 m²); at least 1 person with qualifications for construction site management in the specialization of road works (pursuant to the Act of 7 July 1994 - Construction Law and the Ministerial Regulation of 29 April 2019). Technical or Professional Capacity (Part 2): At least 1 completed construction works contract within the past 5 years involving road construction, reconstruction, or renovation using the same technology (minimum asphalt concrete pavement area of 500 m²); at least 1 person with qualifications for construction site management in the specialization of road works. Qualification for Bidding on Both Parts: May provide two separate works fulfilling the requirements for each part respectively, or provide 1 road works contract involving at least 800 m² of asphalt concrete pavement; assignment of the same qualified person for both parts is permitted. Foreign Tenderers: Permitted to provide equivalent qualifications obtained in other countries, based on the principle of recognition of professional qualifications within EU Member States. Required Qualification Documents: Declaration on Exclusion from Tender: Regarding belonging to the same capital group (pursuant to the Act of 16 February 2007 on Competition and Consumer Protection). Declaration on Qualification Conditions: Regarding the timeliness of information in the declarations referred to in Article 125(1). List of Personnel: Personnel intended to be assigned for contract execution, including their qualifications, authorizations, experience, education, and scope of duties. List of Works Performed: Completed construction works within the past 5 years, including type, value, date, location, and client's confirmation (letter of recommendation, etc.). Consortium Bidding Requirements: Must designate an authorized representative acting on behalf of the consortium; the power of attorney must include tender information, all consortium members, the authorized representative, and the scope of authorization; each consortium member must individually submit declarations on exclusion from tender and meeting participation conditions; a declaration pursuant to Article 117(4) must be submitted, specifying the scope of works for which each member is responsible. Contract Performance Requirements: Employment Requirements: Pursuant to Article 95 of the Public Procurement Law, employment of persons based on an employment contract may be required. Contract Modifications: Permitted, specific conditions and scope are detailed in Clause 18 of Annex 10 to the Tender Dossier. Advance Payment: Not provided. Grounds for Exclusion from Tender: Pursuant to Article 7(1) of the Act of 13 April 2022 on Special Measures for Combating Support for the Aggression against Ukraine and for the Protection of National Security, tenderers falling under relevant circumstances will be excluded. |
