Project Name: Municipal Road Asphalt Paving Project in Itapiranga City Contract Type: Turnkey Contract (Labor and Materials) Contract System: Lump Sum Contract Project Location: Itapiranga City, Santa Catarina State, Brazil Project Specific Content: Divided into 3 lots. Lot 1: Sections I and II of ITG 4296 Road (from SC163 Road to the Soledade Village Community Center), length 740.00 meters, maximum price limit 1,845,040.35 Brazilian Reais. Lot 2: Intersection of ITG 4438 and ITG 4098 Roads, length 144.61 meters, located in Presidente Becker Village, maximum price limit 425,457.29 Brazilian Reais. Lot 3: ITG 4488 Road, length 1,051.10 meters, located in Laranjeira Village, maximum price limit 1,610,822.17 Brazilian Reais. Total Budget for Three Lots: 3,881,319.81 Brazilian Reais Funding Source: General fiscal funds; State-specific transfer payment - Mandatory Amendment; Federal Individual Parliamentary Amendment. Bidding Document Acquisition: Obtain via the Public Procurement Portal (www.portaldecompraspublicas.com.br). Bid Submission Method: Must be submitted online through the Public Procurement Portal. Bidders who do not conduct a site visit must submit the Declaration in Annex IX, confirming understanding of the site conditions and construction requirements. Legal Qualification Documents: Articles of Association and all amendments (commercial companies must be registered with the State Board of Trade); Joint-stock companies must provide the latest minutes of the management election meeting; Civil partnerships must provide proof of management appointment; Foreign companies must provide operating license in Brazil; Simplified Certificate from the Board of Trade (issued within the last year). Tax, Social Security, and Labor Compliance Documents: CNPJ registration certificate; State/Municipal taxpayer registration certificate; Federal Revenue Service Joint Tax Clearance Certificate (including federal taxes and federal debts); State Tax Clearance Certificate; Municipal Tax Clearance Certificate (including Itapiranga City); FGTS (Service Time Guarantee Fund) compliance certificate; Labor debt clearance certificate. Economic and Financial Status Proof: Certificate of no bankruptcy record issued by the bankruptcy court in the bidder's location. Technical Qualification Proof: Registration with CREA (Regional Council of Engineering and Agronomy) or CAU (Council of Architecture and Urbanism), with a scope of business matching the bidding project; Proof of legal relationship between technical personnel and the company (employment contract, election minutes, articles of association, or registration proof with CREA/CAU); Declaration of having a qualified technical team and necessary construction equipment. Mandatory Declaration Documents: Micro/Small Enterprise Declaration; Declaration of No Improper Conduct; Declaration of No Child Labor; Declaration of Job Reservation for Persons with Disabilities and Social Security Rehabilitation; Declaration of CNAE Code for Payroll Tax Reduction; Declaration of No Participation by Incumbent Public Officials; Declaration of Compliance with Decree No. 7.983/2013; Site Visit Declaration; Supplementary Information Declaration. Micro/Small Enterprise Preference Policy: Micro/Small enterprises whose bids are within 10% of the lowest bid can submit a lower bid within 5 minutes; If there are tax compliance issues, they can obtain 5 working days (extendable by another 5 working days) for rectification. Bid Validity Period: Not less than 60 days. Payment Terms: Payment based on measurement results, within 10 days after measurement completion. Payment Submission Requirements: First copy of the Construction Logbook, FGTS payment slip, relevant supporting documents, employee payroll; Must comply with Brazilian Federal Revenue Service Normative Instruction No. 1.234/2012 regarding income tax withholding; Companies under the Simples Nacional regime must indicate it on the invoice and may be exempt from withholding tax. Price Adjustment Mechanism: No adjustment within 12 months; After 12 months, adjustment based on the National Construction Cost Index-M (INCC-M), with the base date being the budget estimation date. Contract Duration: Until April 30, 2027. Construction Period: Executed according to the physical-financial schedule. Warranty Period: Minimum 5 years (for structural soundness, safety, and functionality). Project Acceptance: Must submit INSS and FGTS tax clearance certificates within 30 days after provisional acceptance. Provisional Acceptance: Within 15 days after completion. Final Acceptance: Within 90 days after provisional acceptance, ensuring defects are rectified. Contract Management: Must use a Construction Logbook to record weather, progress, accidents, inquiries, material shortages, number of workers, etc.; The supervisor must record inspection comments, problem resolutions, and rectification requirements in the logbook. Contract Modification Limits: Unilateral Modification: Can increase/decrease the initial contract value by up to 25%. Building/Equipment Renovation: Can add items up to 50%. Clarification and Challenge of Bidding Documents: Must be submitted via the Public Procurement Portal, with a deadline of 3 working days before bid opening; Challenges submitted via email are not accepted. |
