en.Wedoany.com Reported - Brazil's National Data Protection Authority (ANPD) launched a public consultation on Tuesday (30th) to gather suggestions from all sectors of society on the implementation of digital platform rules following the new regulations of the Civil Rights Framework for the Internet. The consultation takes into account the new powers granted to the agency by the government on this issue.

The consultation is being conducted through the Brasil Participativo platform, with a deadline of August 17th. The ANPD seeks recommendations from society on regulatory priorities in areas such as user rights, obligations of digital platforms, and the protection of women in the digital environment. The consultation consists of general and specific question blocks.
In a statement, Camila Leite Contri, ANPD's Alternate Director of Supervision, said the agency considers it necessary to engage in in-depth discussions with society on topics that may guide future regulatory actions, including regulatory standards, parameters for differentiating obligations based on service size and risk, and oversight and transparency mechanisms for internet application providers. Contri noted that the feedback received will support the ANPD's planning of priorities in the new regulatory environment, thereby ensuring user rights in a manner that balances the protection of fundamental rights.
The changes to the Civil Rights Framework for the Internet stem from Law No. 12.975/2026, which updated the regulations and established obligations for internet application providers (such as digital platforms and social networks), requiring them to take proactive action in cases of digital violence without awaiting specific court orders. This new rule reflects the understanding of the Brazilian Federal Supreme Court (STF) regarding the constitutionality of the Civil Rights Framework for the Internet rules, namely that platforms are liable for third-party content. Additionally, Law No. 12.976/2026 establishes guidelines aimed at protecting women in the digital environment. Both regulations grant the ANPD the authority to regulate, supervise, and investigate violations by digital platforms, powers that will be exercised in coordination with the ANPD's existing responsibilities under the General Data Protection Law (LGPD) and the Digital Statute for Children and Adolescents (ECA Digital).
