Description

Tender Title: "Supply of Filters for Heating, Ventilation, and Air Conditioning Systems for the Requirements of the Specialized Department of the National Enterprise 'Radioactive Waste'"

Tender Description: The subject of this public procurement includes the supply of 66 different types of filters, aiming to ensure the microclimate in workplaces meets the requirements for healthy and safe working conditions as well as radiation safety norms. The type, dimensions, and quantity of filters for each individual lot are detailed in the technical specifications in Annex 1 (tabular form) of Technical Assignment No. ТЗ-150/15.12.2025. Delivery will be phased, with the specified quantity for each individual lot divided into no more than 6 deliveries over a period of 12 months.

Division into Lots: The procurement is divided into 4 independent lots.

Lot LOT-0001: HEPA filters, 15 types, 827 units, estimated value 101,866.56 EUR.

Lot LOT-0002: Bag filters and zigzag filters, 35 types, 835 units, estimated value 18,071.92 EUR.

Lot LOT-0003: Panel aerosol filters, 9 types, 1,346 units, estimated value 9,375.54 EUR.

Lot LOT-0004: Other filters, 7 types, 157 units, estimated value 23,209.17 EUR. The performance period for each lot is 12 months.

Reserved Tender: Yes. This public procurement is reserved for specialized enterprises or cooperatives of persons with disabilities under Article 12 of the Public Procurement Act, aiming to promote the employment and economic activity of persons with disabilities and disadvantaged persons. Participation conditions: at least 30% of the list members must be persons with disabilities and/or disadvantaged persons; registration as a specialized enterprise or cooperative must be at least three (3) years prior to the start date of the tender procedure; must be able to perform at least 80% of the contract subject using their own equipment, facilities, and human resources. If subcontractors or third-party capacities are to be used, they must also be specialized enterprises or cooperatives of persons with disabilities. If no such bidders participate, other eligible bidders may also participate.

Grounds for Exclusion: Based on Article 54, Paragraph 1 of the Public Procurement Act and other relevant legislation, grounds for exclusion include: participation in a criminal organization, corruption, fraud, terrorist offenses, money laundering, terrorist financing, use of child labor and human trafficking, failure to fulfill tax obligations, failure to fulfill social security contribution obligations, violation of environmental law obligations, violation of social law obligations, violation of labor law obligations, direct or indirect participation in the preparation of this procurement resulting in unfair advantage, existence of an irresolvable conflict of interest, provision of false information, concealment of information, failure to submit supporting documents or obtaining confidential information, and specific country exclusion grounds (e.g., related to restrictive measures in connection with Russia's actions destabilizing the situation in Ukraine under EU Regulation No. 833/2014 and its amendments). Additionally, bidders will be excluded if they fail to extend or confirm their bid validity period upon request, if their price proposal does not meet the tender document requirements, or if their technical proposal does not meet the contracting authority's requirements.

Selection Criteria:

1. References for Specific Deliveries: The bidder must have completed at least one (1) delivery activity identical or similar to the subject of this public procurement within the last three (3) years prior to the date of bid submission. "Identical or similar delivery activity" means the delivery of air filters for heating, ventilation, and air conditioning systems. The contracting authority does not set a minimum value requirement. If bidding for multiple lots, satisfying at least one similar activity is sufficient. When submitting the bid, the bidder must declare and provide information on the value, date, and recipient of the relevant delivery in Section B, Part IV of the EEDOP (Single Electronic Public Procurement Document), in the field "Supply Orders: Completed Supplies of a Specific Type". Supporting documents must be provided in accordance with the relevant legal provisions.

2. Quality Assurance Standard Certificate Issued by an Independent Body: The bidder must have implemented a quality management system compliant with the BDS EN ISO 9001:2015 standard or an equivalent standard, and the certification scope must cover the supply of air filters for heating, ventilation, and air conditioning systems. The bidder must declare this in Section Г, Part IV of the EEDOP, in the field "Quality Assurance Standard Certificate Issued by an Independent Body". A valid BDS EN ISO 9001:2015 or equivalent quality management system certification certificate must be provided.

Award Criteria: Lowest Price. According to Article 70, Paragraph 2, Item 1 of the Public Procurement Act, evaluation and ranking will be based on the principle of "the most economically advantageous tender", where "the most economically advantageous tender" is determined according to the "lowest price" award criterion. Bids offering the lowest execution price are ranked first.

Post-Contract Award Requirements: The successful bidder must: Fulfill the commitment under Article 112, Paragraph 1, Item 2 of the Public Procurement Act; Provide a performance guarantee equivalent to 2% of the contract value (excluding VAT) of the respective independent lot; If the successful bidder is an unincorporated natural person and/or a consortium of legal persons, provide a copy of the tax registration certificate and BULSTAT registration certificate or equivalent documents as per the laws of the country of establishment. If the successful bidder is a foreign entity, provide the corresponding documents under Article 58, Paragraph 1 of the Public Procurement Act, issued by the competent authority according to the laws of its country of establishment. If its country of establishment does not issue such certificates or if the documents do not cover all cases, a statement having legal significance in that country must be provided; if no legal significance exists, a formal statement made before the competent authority of that country must be provided.

Submission Requirements: Must be submitted electronically via the specified website. The bid language is Bulgarian. The use of electronic catalogs and submission of variant bids are prohibited.

Other Information: This procurement is a recurring procurement, expected to be repeated approximately 12 months later. It is not an EU-funded project. The Government Procurement Agreement (GPA) does not apply. It does not include accessibility standards for persons with disabilities, the reason being that the nature of the procurement subject does not involve services or facilities for public use, nor does it involve direct user participation activities. It is a strategic public procurement aiming to achieve social objectives. It does not include green public procurement criteria. Electronic invoicing is allowed. Electronic ordering or electronic payment is not used. There is no framework agreement or dynamic purchasing system. An electronic auction will not be conducted.
