Minnesota's New PFAS Product Reporting Rule Officially Takes Effect

en.Wedoany.com Reported - On September 15, the first round of reporting for products containing PFAS in the U.S. state of Minnesota officially reached its deadline. Under the state's "Amara's Law" and its accompanying rules, products sold, offered for sale, or distributed in Minnesota that contain intentionally added per- and polyfluoroalkyl substances (PFAS) generally require the relevant manufacturers to submit product information through the Minnesota Pollution Control Agency's (MPCA) PRISM system and pay a one-time $800 reporting fee. Products sold online to Minnesota are also included in the reporting scope.

The reported information includes a description of the product or product category, the PFAS chemicals used, the relevant concentrations, and the function of PFAS in the product or component. Products manufactured before July 1, 2023 are not within the scope of this reporting round; for companies granted an extension, the reporting deadline is extended to December 14, 2026. Thereafter, if the rules require updates, the annual reporting date is February 1 of each year.

This requirement has a relatively direct impact on suppliers of coatings, inks, adhesives, sealants, surface treatment agents, and other fine chemical products. PCI notes that coating manufacturers and raw material suppliers selling relevant products in Minnesota need to verify whether intentionally added PFAS exists in their formulations and components and determine whether reporting obligations are triggered. Except for trade secrets, the submitted information will be made available to the public after review by the MPCA.

Minnesota has previously established a longer-term PFAS control timeline. By 2032, products containing intentionally added PFAS will in principle be prohibited from sale in the state, except in cases recognized as "currently unavoidable uses." This first round of reporting is primarily intended to establish a PFAS product database, providing baseline data for subsequent substitution, regulation, and restriction policies.
